Terms of Use – Artifact Photography

Please read these Terms of Use (“Terms”) carefully.

Definitions

Use of words “website”, “site” and “sites” refers to the ArtifactPhoto.ca domain and any related domains or subdomains owned by 1350286 Ontario Inc.

Use of words “you” and “your” refers to each individual user who may interact with this site.

“Products” include but are not limited to templates, photographs, video, audio recordings, communications, books, workshops, and any other documents available through this site.

ArtifactPhoto.ca

ArtifactPhoto.ca is a resource through which you may obtain general collection and preservation understanding. It provides an online download service for individuals who need general information about tools and techniques in documenting and preserving their collections and artifacts. It also provides access to a photographer (Artifact Photography (a division of 1350286 Ontario Inc.)) who specializes in photographing and documenting collections and artifacts. Artifact Photography is not a professional conservator service.

PRIVACY POLICY

You can manage the personal information you have given to Artifact Photography. We invite you to read the complete statement of our current Privacy Policy available here.

When you visit the Artifact Photography website, your personal information will not be collected unless you choose to use and receive products and services that require it. Your personal information will then only be used to provide you with the services that you select, and for no other purpose. It will only be transmitted to third parties that assist us in our business operations. Artifact Photography is the sole manager of such information collected. You grant Artifact Photography a worldwide, royalty-free, nonexclusive license to use, distribute, reproduce, modify, publish and translate this personal information solely as necessary to fulfill your request(s) or to enable your use of a particular Product or service, such as for shipping of Products.

Links on the Sites may be affiliate links controlled by parties other than Artifact Photography to help support the maintenance of the Sites. Artifact Photography does not assume responsibility for or endorse any contents, products, services or use of any of these affiliate sites and makes no guarantees as to the quality or content of the same. You acknowledge that you bear all associated risks regarding access to and use of affiliate links and release Artifact Photography from any loss or damage incurred from dealing with such affiliate.

INTELLECTUAL PROPERTY LICENSE

Artifact Photography owns all intellectual property rights in (a) all text, logo, images, headers, trademarks, service marks, design elements, and all other protected elements on the Sites (except those licensed from others); (b) any Products and portions therefore; (c) all things otherwise provided to you as a part of Artifact Photography’s services, and; (d) any other intellectual property rights afforded to Artifact Photography, either through provincial or federal registration or as otherwise available at common law (“Intellectual Property”). Except as stated below, Artifact Photography does not grant you any rights to any Intellectual Property contained within the Products or as may be available to you generally through the Sites.

Other than where separately noted, the contents of this site are protected by Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International license (CC BY-NC-SA 4.0). By this license, you are free to share (copy and redistribute the material in any medium or format) and adapt (remix, transform, and build upon the material. The licensor (”Artifact Photography (a division of 1350286 Ontario Inc.)”) cannot revoke these freedoms as long as you follow the license terms:

– Attribution – You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.

Artifact Photography will take whatever legal action is necessary to protect its Intellectual Property in the event of such infringement and asks that you carefully manage your use of the Products, and any other downloaded materials or services to ensure compliance with these Terms.

RETURN/REFUND POLICY

You acknowledge that all Products and materials are non-refundable and not returnable, under any circumstances. All sales are final.

NO WARRANTIES

While we endeavor to provide excellent information and photography, all products are provided “as is”. Artifact Photography offers no warranty, explicit or implied, regarding any intellectual property, or the accuracy of any information, including without limitation, any implied warranties of merchant-ability or fitness for a particular purpose.

Obtaining materials available through this site is done at your own discretion and at your own risk. Artifact Photography makes no warranty that the sites, products or materials will be accurate and reliable in all instances.

LIMITATION OF LIABILITY AND INDEMNIFICATION

Except where prohibited by law, Artifact Photography will not be liable to you or any other entity for damages general, special, punitive, indirect, consequential, or incidental, or lost profits or any other damages, costs, or losses arising from your use of information on the website. Except where prohibited by law, to the extent there is liability found as to Artifact Photography, such recovery is limited to the amount paid to Artifact Photography for materials, products, and services.

GOVERNING LAW; VENUE

These Terms shall be construed in accordance with, and governed in all respects by, the laws of the Province of Ontario. Any dispute between the parties concerning this Agreement shall be subject to the exclusive jurisdiction of the provincial and/or federal courts for the City of Barrie, Ontario. Artifact Photography reserves the right to change or modify these Terms at any time without notice to You. Again, it is your responsibility to review these Terms prior to use and periodically throughout your use of Artifact Photography’s Products, Materials and services.
